the basics:
- Be Respectful. Don't use Chuuzer to harass people or post illegal stuff.
- You Own It. You own your photos and polls, but you let us show them to your friends.
- Liability. We provide a tool for opinions; we aren't responsible for the life decisions you make based on a poll!
- The Contract. By using the app, you're agreeing to these rules.
1. Acceptance of Terms
By using Chuuzer, you’re entering into a legal contract with Chuuzer, LLC (“we,” “us”). If you don’t agree to these Terms, please don’t use the app.
2. Eligibility & Accounts
You must be at least 13 years old to use Chuuzer. We do not knowingly collect any information from users under 13. If we confirm that a user is under 13 years of age, we will take steps to remove that user’s Personal Information from our databases.
You are responsible for all activity that happens under your Account. Because we use phone-number authentication, please keep your device secure. We are not responsible for any unauthorized use of your Account.
When creating an Account, you may not use a username that is offensive, vulgar, or obscene or otherwise in bad taste. We reserve the right to suspend or terminate your Account if any information provided during the authorization process or thereafter appears to be inaccurate, false, misleading, or violates our Terms.
3. Your Content (The “License”)
You retain all ownership rights to the photos, text, and polls you post. However, to make the app work, you grant Chuuzer a worldwide, non-exclusive, royalty-free license to host, store, and display that Content specifically for the purpose of operating the app and showing it to your designated groups.
We don’t have an obligation to monitor your use of the Service or to review any Content, but we have the right to monitor, remove, edit, and block Content or Accounts for the purpose of operating the Service, to ensure compliance with these Terms, or to comply with applicable law or the order or requirement of a court, administrative agency, or other governmental body, as well as to comply with safe usage requirements where required.
We reserve the right, at any time and without prior notice, to remove or disable access to any Content that we consider, in our sole discretion, to be in violation of these Terms or otherwise harmful to the Service.
4. Rules of the Road
We want Chuuzer to be fun and helpful. You agree not to:
- •Post anything illegal, pornographic, or that violates someone else's copyright.
- •Harass, abuse, exploit, bully, or impersonate others.
- •Spam, or make unsolicited offers, advertisements, or proposals to other users.
- •Attempt to hack, scrap, or break the app.
We reserve the right to remove Content or ban or suspend users or Accounts that violate, or in our discretion, appear to violate, these rules.
5. Third-Party Services
Chuuzer connects you with others via SMS (Twilio) and uses other third-party tools (AWS, Google). Your use of the app is also subject to their respective terms. Standard message and data rates from your carrier may apply to SMS verification and invites.
6. Disclaimers: “As-Is”
Chuuzer is a tool to gather opinions from friends. We do not provide professional advice. Any decision you make based on a Chuuzer poll is your own responsibility. We provide the app “as-is” without any warranties of any kind.
7. Limitation of Liability
To the maximum extent permitted by law, Chuuzer, LLC shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the app.
State Requirements. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Acts or Omissions of Third Parties. Chuuzer, LLC is not responsible for the actions, content, information, or data of third parties, and by using the Service you release Chuuzer, LLC from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any such third parties.
Severability
Unless otherwise prohibited by law, if any term or provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or un-enforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction.
8. Governing Law
Chuuzer, LLC is based in Massachusetts, U.S.A. These terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes will be resolved in the jurisdiction of the Commonwealth of Massachusetts.
9. Changes to Terms
We reserve the right to and may update these Terms occasionally. If we make big changes, we’ll notify you via the app.
